1. Who we are
Zook is an online marketplace for renewed and pre-owned electronics, operated by Creato Ventures LLC, a company registered at Sharjah Media City, United Arab Emirates, under license number 2645087 (referred to as “Zook”, “we”, “us” or “our”). These Terms & Conditions (the “Terms”) govern your access to and use of the Zook mobile application and website (together, the “Platform”).
2. Acceptance of these Terms
By creating an account or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Platform.
3. Eligibility and accounts
You must be at least 18 years old and legally resident in the United Arab Emirates to use the Platform. Account registration requires a valid UAE mobile number and identity verification, which may include Emirates ID verification. You are responsible for keeping your login credentials secure and for all activity under your account.
4. Our role
Zook operates the Platform, provides physical inspection and condition grading services, and facilitates payments and delivery between buyers and sellers. Except where expressly stated, Zook is not the seller of listed items; contracts of sale are formed between the buyer and the seller. Zook acts as an intermediary and inspection service provider.
5. Inspection and condition grading
Every device listed on the Platform is physically inspected by a Zook inspector before the listing goes live. Devices are tested, identity checked, and assigned a condition grade from A (like new) to D (fair, fully disclosed). Photographs used in listings are captured live during inspection. Grades reflect the inspector's professional assessment of the device at the time of inspection and are provided in good faith.
6. Listings and prohibited items
Sellers must provide accurate information about the items they submit. It is prohibited to list stolen goods, counterfeit goods, devices with blacklisted IMEI numbers, devices with removed or altered serial numbers, or any item whose sale is restricted or unlawful in the UAE. Zook may reject, suspend, or remove any listing at its discretion, including where a device fails inspection.
7. Buying and payments
When you purchase an item, payment is collected through the Platform's approved payment providers and held until delivery is confirmed. Prices are displayed in UAE Dirhams (AED) and include applicable fees unless stated otherwise. You agree to provide accurate delivery information.
8. Buyer protection
Payment is released to the seller only after the item is delivered. If the item you receive materially differs from its inspected listing (wrong item, undisclosed defect not covered by its condition grade), you may raise a claim through the Platform within the claim window shown at checkout. Zook will review the claim and may arrange a return, replacement, or refund in accordance with UAE consumer protection law.
9. Selling as an individual
Individual sellers may list personal devices by booking an inspection through the Platform. By submitting a device, you confirm that you are its lawful owner, that it is free of any liens or security interests, and that all personal data and activation locks (such as iCloud or Google account locks) have been or will be removed before handover. Payouts are made to your registered payment method after the buyer's delivery confirmation.
10. Vendor accounts
Businesses licensed in the UAE may apply for a vendor account to operate a storefront on the Platform. Vendors must maintain a valid trade license, comply with all applicable commercial and consumer protection regulations, and honor the inspection and grading standards of the Platform. Additional vendor terms may apply and will be presented during vendor onboarding.
11. Fees
Zook charges service fees and commissions as displayed on the Platform at the time of listing or purchase. Fees may change from time to time; changes apply to transactions initiated after the change takes effect.
12. Shipping and delivery
Delivery is performed by Zook or by third-party couriers engaged by Zook. Risk in the item passes to the buyer upon delivery. Delivery timelines shown on the Platform are estimates and may vary.
13. Disputes between users
If a dispute arises between a buyer and a seller, both parties agree to first use the Platform's dispute process. Zook will review evidence from both sides, including inspection records, and issue a resolution. This does not limit any rights you may have under UAE consumer protection law.
14. Prohibited conduct
You must not use the Platform to engage in fraud, misrepresentation, money laundering, harassment, or any unlawful activity; attempt to complete transactions outside the Platform to avoid fees or protections; interfere with the Platform's operation or security; or scrape, copy, or reverse engineer any part of the Platform.
15. Intellectual property
The Platform, the Zook name and logo, and all related content are the property of Creato Ventures LLC or its licensors. You may not use them without our prior written consent, except as necessary to use the Platform as intended.
16. Liability
To the maximum extent permitted by law, Zook's aggregate liability arising out of or in connection with a transaction is limited to the amount paid for that transaction through the Platform. Nothing in these Terms excludes liability that cannot be excluded under UAE law, including mandatory consumer protection provisions.
17. Data protection
We process personal data in accordance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL). By using the Platform, you consent to such processing as described in the Privacy Policy.
18. Amendments
Zook may amend these Terms from time to time. Material changes will be notified to you through the Platform or by email prior to taking effect. Continued use of the Platform after such changes take effect constitutes your acceptance of the revised Terms.
19. Governing law and jurisdiction
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Sharjah. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Sharjah, United Arab Emirates, subject to any mandatory consumer protection provisions that may grant you the right to bring proceedings in your place of residence.
